RESPONDENT

Counsel for the Appellant: MR.G.VIDYASAGAR

Counsel for the Respondent: Mr. Ravindranadh The Court made the following :

JUDGMENT :(Per the Honourable Smt. Justice T.Meenakumari)

This writ appeal is filed by the writ petitioner-appellant herein aggrieved bythe order in W.P. No:25165 of 1999, under which the learned single Judge disposedof the said writ petition by recalling the interim order dated 8-12-1999.

In view of the fact that the writ petitioner is facing a criminal case undersection 498 A of the Indian Penal Code, under regulation 11 of the A.P. StateElectricity Board Employees Disciplinary and Appeal Regulations, the respondent-Corporation placed the writ petitioner under suspension. While admitting the writpetition, the said suspension order was stayed and at the time of disposal of themain writ petition, the learned single Judge has recalled the interim order granted on8.12.1999. Challenging the same, the present writ appeal has been preferred by thewrit petitioner. During the pendency of the appeal, the writ petitioner died and hislegal representatives were brought on record.

During the pendency of this appeal, the legal representatives have also filedan application in W.A.M.P.No:3660 of 2004 seeking to release the terminal benefits. In view of the death of the writ petitioner, nothing survives to proceed in this appealand as such, instead of considering the W.A.M.P., the main writ appeal is disposedof.

In the facts and circumstances of the case and in view of the fact that the legalrepresentatives of the writ petitioner have already been brought on record, withoutexpressing any opinion on the merits of the case, We deem it appropriate to directthe respondent to release the terminal benefits to the legal representatives of thedeceased writ petitioner in accordance with the regulations of the Corporation withina period of eight weeks from the date of receipt of a copy of this order.

Accordingly, the appeal is disposed of. No costs.
