Petition under Article 226 of the Constitution of India praying that in thecircumstances stated in the affidavit filed therewith, the High Court will be pleased toissue an appropriate writ, order or direction more particularly one in the nature of writof Mandamus declaring the action of the respondent in not accepting my tender by ahand in respect of the work “Silt Arresting Tank” near Downelli Village of KuntalaMandal of Adilabad District vide E. Procurement Notice No.16/2003-2004, dated 28-10-2003 is arbitrary, illegal and unconstitutional and consequently direct therespondents to receive the tender of the petitioner and consider the same inaccordance with law.

The petition coming on for hearing, upon perusing the petition and the affidavitfiled in support thereof and upon hearing the arguments of Mr.R.N. HemendranathReddy, Advocate for the Petitioner and of the Govt. Pleader for Irrigation for theRespondent.

The Court made the following ORDER :

“Call the Writ Petition for admission on 01-12-2003. In the meanwhile,the petitioner’s tender shall be accepted.”
