ORDER:

HON’BLE SRI JUSTICE R. SUBHASH REDDYWRIT PETITION No.39014 of 2012

Heard learned counsel for petitioners as well as thelearned Standing Counsel appearing for respondents.

The petitioners in this writ petition seek directions by way ofMandamus, to declare the action of respondents in not takingsteps on their applications for allotment of shops constructedwithin the premises of Zilla Parishad Girls High School,Sangareddy, Medak District, as illegal.

The petitioners claim for allotment of shops, on the groundthat they are street hawkers and are eking out livelihood on push-carts.

On the other hand, it is submitted by the learned StandingCounsel appearing for respondents that the construction of shopsis not yet completed, and after completion of construction, theyfollow due procedure for allotment of shops.

In the absence of any policy decision for allotment of shopsto the hawkers, the petitioners cannot claim for allotment as amatter of right. As the shops are constructed by the ZillaParishad in the Zilla Parishad School premises, it is for therespondents to make allotment by following due procedure eitherby tendering or through auction process. As there is no basis forthe claim of petitioners for allotment of shops, I do not find anymerit for grant of directions as prayed for.

The writ petition is accordingly dismissed. No costs.

As a sequel, WPMP.No.49494 of 2012 also standsdismissed.
