ORDER:
Heard both sides.
It appears, the vehicle bearing Registration No.AP 07 W 7773,belonging to the petitioner, was seized by the 2[nd] respondent-Assistant Motor Vehicles Inspector, Regional Transport Authority,Secunderabad, on 07.10.2009, under a check report, on the allegedirregularities mentioned in the said check report. It is the grievance ofthe petitioner that there are no such irregularities and its request torelease the vehicle has not been considered.
In the facts and circumstances of the case, without expressingany opinion on merits, the respondents are directed to release thevehicle bearing registration No.AP 07 W 7773 to the petitioner, oncondition of the petitioner depositing a sum of Rs.10,000/- (Rupees tenthousand only) and furnishing an undertaking to the effect that it willnot alienate the vehicle or create any third party encumbrance over itand will not alter its nature, during the pendency of enquiry. However,the amount so deposited by the petitioner shall be subject to furtherenquiry under the check report dated 07.10.2009.
With the above directions, the writ petition is disposed of. Noorder as to costs.
