ORAL ORDER:
The learned Government Pleader for Social Welfare haspointed out that the dispute in this writ petition concerns thepromotion to the post of Hostel Welfare Officer in the TribalWelfare Department of the Government of Andhra Pradesh. Therefore, the lis at the first instance must be agitated before theAndhra Pradesh Administrative Tribunal, in view of the judgmentrendered by the Supreme Court in L.Chandra Kumar Vs. Unionof India reported in 1996 Supreme Court Page 1125.
It is reported that the petitioner is continued based on theinterim direction given earlier in this writ petition.
To sub-serve the interest of justice, the order dated31.12.2007 passed in W.P.M.P.No.36767 of 2007 in W.P.No.28132of 2007 shall be in force for four more weeks or till the petitionerapproaches the Andhra Pradesh Administrative Tribunal and filesthe necessary application, whichever is earlier.
Thus, preserving the liberty to the petitioner herein toapproach the Andhra Pradesh Administrative Tribunal, at the firstinstance, this writ petition is dismissed. There shall be no orderas to costs. As a sequel to it, miscellaneous petitions, if anypending in this writ petition, shall stand closed.
