In view oF:he decision rendered by this Court in GaddameediNagamani Vs. ;tate of Telangana & Othersr the r:rdr:r of takingcognizance by t re Magistrate under the provisions of' the DomesticViolence Act, 20 15, is an appealable order under Sec:tion 29 of theDomestic Violer:e Act, 2005. Under these circu Tlstances, thepetitioners are ( iven liberty to file an appeal before the court ofSession, as cont( mplated under law.
4. Further, inview of the decision in Giduthuri Kesari Kumarand others Vs.State of Telangana and others2, the remediesavailable to the/ictim under the Domestic Violence Act are civil innature. Therefor3, it is not appropriate to insist the personalappearance of tre petitioners, except on the dates vyhen theirpersonal appearatce is required. Further, the Court below is directedto follow the guid:lines formulated by this Court in Giduthuri KesariKumar's case (re'e rred supra ).
