HON’BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALEAND

THE HON’BLE SRI JUSTICE S.V. BHATT

W.A.No.608 OF 2015

PC:(Per the Hon’ble Sri Justice S.V.Bhatt)

Heard learned Advocate General for the appellant-University and Mr.S.Niranjan Reddy for respondent-institution/college.

Apropos our orders dated 15.07.2015, 23.09.2015 and 06.11.2015, we have considered and examinedthe status of compliance on deficiencies which resulted in disaffiliation and whether the respondent-College hasmade good these deficiencies or not.

The respondent-institution through W.A.M.P.No.3037 of 2015 has placed on record the material relatingto the alleged deficiency of faculty noticed by the Fact Finding Committee (FFC), the manner of making goodthis deficiency and the objection against appellant-University in treating the deficiency as still subsisting. Withthe assistance of learned counsel appearing for both the parties, we have perused the status reports filed by the committees and also the Assistant Registrar of this Court.

The objection pointed out by the University is that the institution does not have Ph.D faculty in B.Tech CivilEngineering and M.Tech Structural Engineering. The response of respondent-institution is that the Ph.D facultyavailable in the institution is in the civil engineering department, which includes B.Tech Civil Engineering,M.Tech Structural Engineering and Transportation Engineering. The other objection pointed out by theappellant-University is that in B.Tech Mining Engineering, respondent-institution appointed B.Tech graduatesas faculty instead of M.Tech post graduates. The reply of respondent-institution is that there is acute dearth ofM.Tech qualified faculty in this branch and the appellant-University for the current academic year accepted theappointment of B.Tech graduates as faculty in other colleges for which affiliation is granted.

We have carefully considered the compliance of deficiency and the minor objection pointed out by theUniversity. We are satisfied that the respondent-institution has substantially complied with all the deficienciesand the respondent-institution ought not have been refused affiliation for the academic year 2015-16 for thecourses covered by this writ appeal.

Having regard to these circumstances, the appeal is disposed of.

The respondent-institution is allowed to run B.Tech/M.Tech courses for which admissions have beentaken up and completed pursuant to our orders in this batch of cases under management and convenor quotas. The respondent-institution shall not admit any more students for the academic year 2015-16 in B.Tech/M.Techcourses. It is open for the respondent-institution to apply afresh for the next academic year to AICTE and theUniversity for grant of approval and affiliation to the college for the courses it intends to run in the comingacademic year.

The request for grant of approval/affiliation, as the case may be, will be factually verified, considered andappropriate orders are passed well ahead of next academic year.

Consequently, miscellaneous petitions, if any pending, also stand disposed of.
