Ravinder, learned Assistant Government Pieader forRevenue. Perused the record.
2. The lis involved in both the writ petitions andsubject property is one and the same. Therefore, both thewrit petitions were heard together and decided by way ofthis common order. The official respondents are referredto as arrayed in W.P.No.580 1 of 2022. Respondent Nos. 6
to 25 and 27 to 45 are referred as members of respondentNo.4 Association.
3. Petitioners are (2g) in number. They belong toScheduled Caste community. Their forefathers and aftertheir death, their fathers and thereafter, petitioners are inpossession of land admeasuring Ac.6.OO gts. in Sy.No.46situated at Meerpet Village of Balapur Mandal, RangaReddy District. They are in possession of the subject landsince last 10 decades.
4. In the year 1973, some of their family membersobtained loan from Dena Bank, Saroornagar Branch fordevelopment of the said tand. They are cultivating thesaid land. They have also obtained electricity connectionand paying consumption charges to the ElectricityDepartment. Thus, they claim ttrat they are in possessionof the subject property.
5. In the year 1998, respondent Nos. 1 to 3 tried todispossess the family members of petitioners along withfamily members of Bommana family. Therefore, they havefi,ed a writ petition vide w.p.No.31559 of 199g. videorder dated 13.06.1999, this Court referring to the order dated 02.01.1997 in W.P.No.3583l of 1997 disposed ofthe said writ petition directing the respondents thereinnot to demolish the structures nor to dispossess thepetitioners therein from the land to an extent of Ac.6.0Ogts. situated in Sy.No.46 of Meerpet Village, SaroornagarManda,l, without foilowing due process laid down underlaw.6. The respondent authorities in view of the aforesaidorders passed by this Court, conducted [panchananama']dated 12.01.2022 and delivered [possession ]of [subject]property to respondent No.4 Association. Challenging thesaid impugned panchamarna issued in favour [of]respondent No.4 Association, petitioners in W.P.No.37820of 2022 filed the said writ petition. Thereafter, [respondent]No.4 Association a-lso filed a suit vide O.S.No.304 [of ]2022against some of the [petitioners ]seeking [perpetual]injunction. Along with the suit,anInterlocutoryApplication vide LA.No.33 of 2022 seeking ad-interiminjunction was fiIed. Vide order dated [09.O5.2022,]
learned Special JFCM, Excise_cum_Vll Addl. Junior CivilJudge-cum-Vll Addl. Metropolitan Magistrate atL.B.Nagar, Ranga Reddy District dismissed the said I.A.Feeling aggrieved by the sarne, respondent No.4Association preferred an Appear vide C.M.A.No.3S of2022. The same was also dismissed. The said ordersattained finality.
7. On 2g.O1.2O22, staff of respondent Nos. 1 to 3requested the petitioners to vacate the schedule landwithout issuing any notice and without following dueprocedure laid down under law. Respondent Nos. 1 to 3informed the petitioners that the subject property belongsto Government ald therefore, petitioners have to vacatefrom the subject property within one week. petitionershave furnished copy of order dated 13.06.1999 inW.P.No.31559 of l99g to the stalT of respondent Nos. 1to 3. They have not considered the same. Thus, the entireaction of respondent Nos. 1 to 3 in trying to vacate thepetitioners from the subject land without following due procedure laid down under law is arbitraqr, illegal andalso in violation of [. ]order dated 13.06.1999 inW.P.No.31559 of 1998. Challenging the said action ofrespondents, petitioners in W.P.No.5801 of 2022 filed thesaid writ petition.
8. Respondent No.4 contended that he is working asPresident of Ranga Reddy District Rickshaw Pullers andDaily Waged Workers Welfare Association, a registeredAssociation. The said Association is formed for thewelfare and rehabilitation of its members, who areRickshaw pullers. They have a,lso succeeded in securingthe assignments with regard to land in Jagatgirigutta inthe year 198 1, Kachwani Singaram in the year 1985 andMeerpet in the year 1993. Thus, the said Association isfighting for the wellare of its members who are Rickshawpullers.
9. The said Association succeeded in getting pattacertificates in respect of Meerpet land in the year 1993.But due to some obstruction caused by local people, the /
members of the said association were not in a position totake possession of the said property. Thus, there wasdelay. Therefore, they have filed a writ petition videdelay. Therefore, they have filed a writ petition videW.P.No.27974 of I99g and the sarne was disposed of on09.02.2001.09.02.2001.
10. A housing layout was prepared by the then HUDAfor tota_l extent of Ac.22.25 gts. in Sy.No.46 of Meerpet.Members of the said Association numbering about 23Ohave to be allotted the plots, but due to encroachmentsmade by Toddy Tappers, Washer man community and forBuria_l ground, the.y lost 100 plots. About 15O assigneeswere actually shown physical possession leaving gOassignees to their fate. In the year 2006, Government hasissued G.O.Ms.No.493, dated 2g.O4.2006 banningallotments of individual house plots and carne out with arevised policy to accommodate the houseless people inthe Rajiv Gruhakalpa and other similar housing schemes. Therefore, the members of the said Association had nooption but to act as silent spectators.
11. Thereafter, a writ petition vide W.P (PIL) No.249 of2017 was filed assailing the said G.O and the Circularinstructions issued by the then Collector, Ranga ReddyDistrict, cancelling all the assignments made prior to2006. Vide order dated 30.10.20 18, a Division Bencha-llowed the said writ petition and set aside the saidproceedings. They have not initiated further action incompliance with the said orders. Therefore, they haveIiled a contemptCASC. They have also approachedLokay'uktha. Thereafter, the Tahsildar, Balapur Ma-ndalconducted physical verification of the area and submittedreport to the District Collector on 08. 12.2O16. Copy of thesarne was forwarded to the Lokal'uktha. Vide order dated21.O9.2O2O, Lokayrrktha directed the authorities toinduct the members of the association physically withinone month from the date of report. The Tahsildar vidememo dated 30.06.2O2L, directed the Manda-l Surveyorand the Additional Mandal Girdavar, Balapur to inspectthe subject land situated in Sy.No.46 of Meerpet withreference to layout by the HUDA and report compliance (
for taking necessary action in the matter. Thereafter, theTahsildar vide letter dated l1.ll.2o2l requested theStation House Oflicer, Meerpet police station to providepolice protection to the staff and the beneficiaries in theprocess of plotting and delivering possession and whenthe Revenue Inspector faced hardship, he sought the helpof police, who in turn gave assistance to thern indelivering possession on 12.O1.2022. Thus, the membersof the said Association took possession and started layingthe roads, drainage pipeline and other structures over anextent of Ac. 1.2O gts. They agreed to forego 35 plots outof 8O plots so as to accommodate the writ petitioners. Infact none of the writ petitioners are entitled for anyallotment whatsoever under the revision videG.O.Ms.No.493 of 2006, dated 28.O4.2006.
L2. The Government has to either modifu G.O. or seekan amendment to allot the plots to the writ petitioners. Therefore, the present writ petition is not maintainable. They have hled the present writ petition with a mala hde
intention. A case in Crime No.60 of 2022 under Sections447, 427 rlw.34 of IpC was registered by p.S.Meerpetagainst the writ petitioners. They were arrested andenlarged on bail. Thus, with the said contentions, respondent No.4 sought to dismiss the present writpetition.
13. The aforestated facts would reveal that thepetitioners are claiming right over land admeasuringAc.6.00 gts. in Sy.No.46 of Meerpet Village, BalapurMandal, Ranga Reddy District. According to them, theirforefathers, their fathers and thereafter, petitioners are inpossession of the said property. When respondent Nos. 1to 3 tried to dispossess their family.members and others, they have filed a writ petition vide W.p.No.3iS59 of 199gand this Court vide order dated 13.06.1999 referring tothe order dated O2.01 .1992 in W.p.No.35g3l of l99Tdirected the respondents not to dispossess the petitionerstherein and not to demolish the structures in the subjectproperfy i.e. in the land to an extent of Ac.6.0O gts.
situated in Sy.No.46 of Meerpet Village, SaroornagarMandal, without following due process laid down under1au,.
L4. It is relevant to note that in the said order, thisCourt referred the order dated O2.Ol.lg97 inW.P.No.35831 of L997. Vide the said order datedO2.O1.L997 in W.P.No.3S831 of 1997, this Court heldthat the property of the petitioners situated in Sy.No.45,admeasuring Ac.1.10 cents situated at Mansoorabad,Saroornagar Manda_l, Ranga Reddy District shall not beinterfered with by respondent No.4 nor he should takeany action to demolish the structures without takingrecourse to law and without putting the petitionerstherein on notice.
15. Petitioners filed photographs to show that they dugbore well and they have obtained electricity connection.16. Perusa-l of documents filed by respondent No.4would revea-l that Ralga Reddy District Rickshaw pullers and Daily Waged Workers Welfare Association, represented by its president filed a writ petition videW.P.No.27974 of 1998 to declare the action ofrespondents therein in not handing over physicatpossession to the patta holders in Sy.No .46 of MeerpetVillage, Saroornagar Mandal, Ranga Reddy District, asillegal. Vide order dated 09.O2.2OO1, this Court disposedof the said writ petition directing the respondents thereinto take all necessar5r steps and see that no constructionis made by any unauthorized person in the land allottedto the beneficiaries. No construction shall be allowed tobe made in open space. The respondents sha_ll also takenecessary steps to prevent the encroachments into theland, which is already allotted to the beneliciaries andweaker sections of the societSr.

22. Learned counsel for the petitioners also wouldcontend that while conducting panchanama on12.O1.2022, respondent No. 1 did not put the petitionersin W.P.No.3782O of 2022 on notice. Whereas, learnedcounsel appearing for respondents and learned AssistantGovernment Pleader for Revenue would contend that thefamily members of the petitioners were present and thesarne was recorded in the said panchanama.

21o. The aforestated facts [would ][reveal ][that ][both ][the]petitioners and members of the aforesaid [Association ][are]claiming right over the subject [property. ][There are ][three]aforesaid orders with respect to subject [property]1. e.1) order dated 13.06.1999 in W.P.No.31559 of 1998,2) order dated 09.02.2001 in W.P.No.27974 of 1998 and
3) order dated 30.10.2018 in W.p (pIL) No.249 of 2Ot7and batch.
26. Vide aforesaid order dated 30.10.2018 in W.p (pIL)No.249 of 2017 and batch, a Division Bench grantedliberty to the Revenue authorities to examine individualcases and if circumstances wa_rrant, issue notice, affordopportunity to beneficiaries and pass orders. It appearsthat respondent Nos. l to 3 conducted panchanama dated12.OI.2O22 and delivered possession of the plots in anextent of Ac. 1.20 gts. to the members of the aforesaidrespondent No.4 Association. petitioners herein are alsoclaiming that they a-re the absolute owners andpossessors of land admeasuring Ac.6.0O gts. in Sy.No.46situated at Meerpet Village, Balapur Mandal, RangaReddy District. Vide order dated 13.06.1999 inW.P.No.31559 of i99g, this Court directed respondentNos. 1 to 3 not to dispossess the family members ofpetitioners from the subject property. Thus, dispute iswith regard to land in Sy.No.46 of Meerpet Village. The dispute is going on since 1998. Both petitioners andmembers of the aforesaid association are claiming rightover the subject property and that they are in possessionof the said property. The extent is different.

27. In the light of the aforesaid discussion, both the writpetitions are disposed of directing the District Collector,Ranga Reddy District, the Tahsildar, Balapur Mandal, respondent Nos.2 and 3 in W.P.
