This writ petition is filed with the following prayer:
When the matter is taken up for consideration, it is brought to mynotice by the learned counsel for the petitioner that in identicalcircumstances, W.P.No.25426 of 2008 is disposed of by this Court byorder dated 10.11.2009 setting aside the order impugned therein andgranting liberty to the respondents to issue fresh show cause noticespecifying all the grounds upon which the change in the seniority ofthe petitioners therein was proposed.
Learned standing counsel appearing for the Corporation is notdisputed the fact that the petitioners herein are also similarly situated.
Since the ratio laid down in the W.P.No.25426 of 2009 issquarely attracted, following the same, the impugned order dated09.12.2009 is hereby set aside and the writ petition is disposed ofleaving it open to the respondents to issue fresh show cause noticespecifying all the grounds upon which the change in the seniority ofthe petitioners is proposed and pass appropriate orders afreshfollowing due process of law. No costs.
