ORDER:

It is the case of the petitioner that against the order passed by the Sub-Collector, Madanapalle, Chittoor District-2[nd] respondent in proceedings inD.Dis.(B1).4643/2005, dated 11-09-2006, in cancelling the DKT patta grantedin favour of the petitioner in respect of the land admeasuring Ac.0-75 cents inSy.No.469/8B situated at Piler Village and Mandal, Chittoor District, thepetitioner filed an appeal along with stay application before the 1[st]respondent and the same is numbered as R.O.C.No.E8/9791/2006. It isstated that so far neither the stay application nor the appeal has beendisposed of.

As the appeal is pending, without expressing any opinion on themerits of the case, I am of the opinion that it is just and proper to direct the 1[st]respondent to consider and dispose of the appeal itself.

Accordingly, the writ petition is disposed of directing the 1[st]respondent to consider and dispose of the appeal pending inR.O.C.No.E8/9791/2006, which is filed against the order of the 2[nd]respondent, dated 11-09-2006, in proceedings in D.Dis.(B1).4643/2005, asexpeditiously as possible, in accordance with law. Pending disposal of theappeal, status-quo obtaining as on today with regard to the possession of theland in question shall be maintained. There shall be no order as to costs.
