HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDYWRIT PETITION No.40760 of 2014Date:31.12.2014

Between:

Md.Ali Pasha,S/o Md. Osman Miya

..... Petitioner

And:

The State of Telangana, reptd by its Commissioner of Civil Supplies Department and Ex-OfficioSecretary, Hyderabad and three others.

.....Respondents

Counsel for the Petitioner: Sri Bollam Lingaiah Yadav Counsel for the Respondents: GP for Civil Supplies (TS)

The Court made the following:ORDER:

The grievance of the petitioner is that respondentNo.2 is not disposing of the stay application filed by him inthe appeal filed against order, dated 25.11.2014, ofrespondent No.3 cancelling his fair price shopauthorization.

A perusal of the record shows that questioning theorder, dated 25.11.2014, of respondent No.3, thepetitioner filed an appeal before respondent No.2 on27.12.2014 After waiting for one day, he has filed thepresent Writ Petition on 29.12.2014.

In my opinion, the petitioner has approached thisCourt in a great hurry without even giving reasonable timefor respondent No.2 to consider the stay application. Therefore, the Writ Petition is dismissed as pre-mature,with liberty to the petitioner to approach this Court aftergiving respondent No.2 sufficient time for disposal of the stay application.

As a sequel to dismissal of the Writ Petition,WPMP.No.51095 of 2014 filed by the petitioner for interimrelief is dismissed as infructuous.
