THE HON’BLE SRI JUSTICE NOOTY RAMAMOHANA RAO

WRIT PETITION No. 32941 of 2010

O R D E R:

This Writ Petition has been instituted seeking a mandamusdeclaring the action of the 3[rd] respondent in removing the petitionerfrom services of the Field Assistant as illegal and arbitrary.

The petitioner was appointed as a Field Assistant under theNational Rural Employment Guarantee Scheme, notified under theprovisions of the National Rural Employment Guarantee Scheme Ac,2005. The grievance of the writ petitioner is that now the respondentsare contemplating to terminate his services without issuing any notice.

Heard Sri A. Purushothama Reddy, learned counsel for thepetitioner and Smt. Ch. Vedavani, learned Standing Counsel for the3[rd] respondent.

As of now, neither any notice was issued to the petitioner nor isthere any order passed terminating his services. In anticipation of thepurported action, the petitioner cannot seek relief as prayed for. However, as it is stated that he was not issued any show cause notice,I direct that if for any reason, the services of the petitioner are to beterminated, he shall be given an opportunity by way of a show causenotice before passing such order and unless such a course is adopted, his services cannot be terminated.

With this, the Writ Petition stands disposed of. No costs.
