ORDER
This transfer petition is hled under Section 24 ol the CivilProcedure Code, praying the Court to transfer A.S.No.31 I of 2Ol4pending on the file of the XXVI Additional Chief Judge, City CivilCourt, Hyderabad, to any other Court in the same premises.Court, Hyderabad, to any other Court in the same premises.
2- The brief facts of the case are that the petitioner herein hledO.S.No.405O of 2OO3 on the file of the VI Junior Civil Judge, Citycivil court, at Hyderabad, seeking perpetual injunction to restrainrespondent Nos.2 and 3 herein from demolishing the compound wallsurrounding the suit schcdule property and to restrain respondentNos.1 and 4 from interfering with peaceful possession and enjoymentof petitioner herein over the suit schedure property. In the said suit,written statement was hled on behalf of respondents. After hearingeither side, the trial court granted perpetual injunction in favor ofpetitioner herein uide judgment and decree dated 25.O9.2O14.Challenging the same, the respondent No. t herein preferredA.S.No.31l of 2Ol4 pending on the file of the XXVI Additional ChiefJudge, Cily Civil Court, Hyderabad.
3. Heard Sri Pramod Singh, [learned counsel ][for ][petitioner.]In spite of service [of ][notice, there ][is ][no ][representation ][on ][behalf ][of]respondents.

Learned counsel [for ][petitioner ][contended ][that ][the ][appeal ][suit]filed by respondent [No.1 herein ][is of the ][year 2074 ][and ][all ][the ][while]the respondent [No.1 ][has ][been ][successful ][in ][dragging ][the matter ][tiil]date. He [submitted ][that ][in ][the ][said A.S., ][the ][petitioner herein ][hled]I.A., seeking [stay ][of ][all ][proceedings ][but ][the ][same ][is ][not ][disposed ][of]since 9 [years ][and the reliel ][sought [or, ][was ][rejected' ][He specifically]contended that the [Presiding Officer ][who ][took ][charge ][of ][the ][XXVI]Additional Chief [Judge, ][City Civil Court, ][Hyderabad, ][is ][the ][colleague]of counsel appearing [in ][the ][trial ][Court on ][behalf ][of ][respondent ][No' ][1]herein, therefore, [there ][is ][possibility ][of ][miscarriage ][of ][justice ][and]biased [judgment, ][as ][such, ][prayed ][the ][Court to transfer ][A.S.No'31 ][1 ][of]2014 pending on [the ][fite ][of ][the ][XXVI ][Additional ][Chief Judge, City]Civil Court, Hyderabad, [to any ][other Court ][in ][the ][same premises']

Having regard to the submissions [made by learned counsel for]on [going ][through ][the record, ][it ][is ][noted ][that ][originally]petitioner, and A.S.No.31l of 2Ol4 [was ][filed ][before ][the ][III ][Additional ][Chief ][Judge,]City Civil Court, [at ][Hyderabad, ][but ][the ][same ][was ][then transferred ][to]
the XXVI Additional Chief Judge, City Civil Court, Hyderabad, onadministrative grounds.

The limited grievance of peritioner is that A.S.No.3r 1 of 2o14 ispending on the file of the XXVI Additional Chief Judge, Ciry CivilCourt, Hyderabad, and the presiding Ofl-rcer who took charge of thesaid Court is the colleague of counsel appearing in trial Court onbehalf of respondent No. I herein, as such, there is possibility ofmiscarriage of justice. However, the court is informed that atpresent, the said Presiding officer is not hording the XXVI AdditionalChief Judge, City Civil Court, Hyderabad, as he was transferred fromthe said court uide transfers dated 09. 1r.2o23. rn view thereof, thecause in the present transfer petition does not survive and the sameis liable to be dismissed.
7 ' Accordingly, this Transfer civil Misce aneous petitionISdismissed. There shall be no order as to costs.
