HON'BLE SRI JUSTICE RAMESH RANGANATHAN
WRIT PETITION No.38164 of 2012
ORDER:
The relief sought for in this Writ Petition is to directrespondent Nos.2 and 3 to cause investigation into the matter.
The Station House Officer, II Town Police Station,Rajahmundry, is present in the Court. He submits that neither hasany complaint been lodged by the petitioner, nor is a copy of anysuch complaint, which the petitioner claims to have filed earlier, been enclosed along with the Writ Petition. His counter-affidavitdiscloses that the complaint lodged by the petitioner is beinginvestigated for offences under Sections 498-A and 306 read with34 I.P.C.
The petitioner’s grievance is that investigation should becarried for the offence under Section 304-B I.P.C. also. It would bewholly inappropriate for this Court to monitor investigation on adaily basis. It needs no emphasis that, in case, the investigationdiscloses an offence having been committed under Section 304-BI.P.C., the Investigating Officer would submit a final report interms thereof.
The Station House Officer, who is present in Court, submitsthat the investigation shall be completed, and a final report wouldbe filed, within one month from today.
The cause in the Writ Petition does not survivenecessitating adjudication by this Court. Recording the submissionof the Station House Officer that a final report would be filed within one month, the Writ Petition is closed. No order as to costs.
The Miscellaneous Petitions, if any, pending in this WritPetition also shall stand closed.
