Accordin; to iearned counsel [for. ]lhe [petitior:rer. ][even ][after]classification o1 the loan accoullt of [the ][petitioner ][as ][Non ][Perfcrrming]Asset QJPA), retitioner has continued to [repay ][the ][loan by ][rvay ][of]Equated Mont rly Instalmelts (EMI) and [the ][nert ][tiMI ][is ][due ][on]05.01.2022.

Without :ntering into the merits, [we ][are ][of ][the ][view that ][since]respondent has taken action against the petitioner [undcr the provisions]of the Securit sation and [Reconstruction ][oF ][lrinarr':ial Assets ][and]Enforcement c : Security Interest Act,2002 [(for ][short 'thr: SARFAIISI]Act), petitiont r should avail her remedy [under Section ][1 ][7 ][of ][the]SARFAESI A:t by frling Securitisation Application [before ][the]jurisdicuonal D :bts Recoverv Tribunal.

6. If the pedtroner fiies such an application within a period of thirrydays kom today, the same shal.l be considered by the Tnbunal inaccordance with iaw.

7. In the meanwhile, petitioner shall continue b pay the EMIsincluding the EMI .ue on 05.0,1.2022ti11 such orders as may be passedby the Tribunal.

8. In the meanwhile, respondent shall not take coercive steps againstthe petitioner.
