ORDER:

WRIT PETITION No.15503 OF 2009

This writ petition is filed seeking a declaration that the orderdated 5.5.2009 passed by the 2[nd] respondent placing the petitionerunder suspension pending enquiry with immediate effect as arbitraryand illegal.

When the matter is taken up for consideration, it is brought to mynotice by the learned counsel for the petitioner that during thependency of this writ petition by order dated 17.8.2009 the impugnedorder of suspension was revoked. Hence, no further enquiry isnecessary in this writ petition.

Though the learned counsel for the petitioner across the barsubmitted that in spite of the revocation of suspension, the petitioner was not allowed to attend the duty, the learned Standing Counselappearing for the respondents disputed the same. Such a disputedquestion of fact cannot be gone into in this writ petition and at any ratesince the said issue is beyond the scope of this writ petition, it is not necessary to keep this writ petition pending any longer.

Accordingly, the Writ Petition is disposed of. No costs.
