WRIT PETITION No.33718of2010

This writ petition is filed questioning the action of therespondents in seizing Tractor bearing No.AP 07E 6328 and Trailerbearing No.AP 07E 6329 belonging to the petitioner.

When the matter is taken up, it is submitted by the learnedcounsel for the petitioner that in similar circumstances, this Courtdisposed of W.P.No.31223 of 2010 on 10.12.2010, directing therespondents - authorities to release the seized vehicle subject to thepetitioner therein producing the receipt showing payment of penaltyamount along with the ownership documents. A copy of the said orderis placed on record. Learned counsel for the petitioner prays fordisposal of this writ petition also with the same directions, for which,the learned Assistant Government Pleader for Mines and Geologyappearing for the respondents reported no objection.

In view of the above, the writ petition is disposed of with thedirection to the respondents to release Tractor bearing No.AP 07E6328 and Trailer bearing No.AP 07E 6329 to the petitioner subject tohis producing the official receipt showing payment of penalty amountas contemplated under the Andhra Pradesh Minor Mineral ConcessionRules, 1966, framed under the Mines and Minerals (Regulation andDevelopment) Act, 1957, along with the ownership documents. Noorder as to costs.
