ORDER:

Heard learned counsel appearing for the petitioner as well asthe learned Government Pleader for Revenue appearing for therespondents.

2. Petitioner seeks a writ of mandamus declaring the actionof the respondents in interfering with the possession of theproperty of the petitioner in an extent of ac.1.50 cents inSy.Nos.70/4B, 70/5, 70/7 and 70/8B of Janupalli village,Amalapuram mandal, East Godavari District without passing anyorders or recourse to law having received the notice, dated 01-12-2007, issued by the petitioner, as illegal and arbitrary.

3. It is the case of the petitioner that he is the owner andpossessor of an extent of Ac.1.50 cents in four bits covered bySy.Nos. 70/4B, 70/5, 70/7 and 70/8B of Janupalli village,Amalapuram mandal, East Godavari District and a coconutgarden. Whileso, without initiating any legal proceedings when thepossession of the petitioner was sought to be interfered withpetitioner got issued a notice, dated 01-12-2007, but no reply has been given. Hence, the present WritPetition.

4. Having regard to the facts and circumstances, withoutexpressing any opinion with regard to the merits of the case, and whether the said land is a private land, assigned land or aGovernment land, respondents are directed not to dispossess thepetitioner without following due process of law.

5. Accordingly, Writ Petition is disposed of. No order as tocosts.
