ORDER:

The petitioner is statedly freedom fighter. He approached theHon’ble Chief Minister for allotment of house site. The same was sent torespondent No.2, namely, the District Collector, Ranga Reddy District, who by memo No.E5/1425/2000 dated 28.08.2004 informed thepetitioner that no land is available in Ranga Reddy District for allotmentof house site and that the petitioner shall approach the native DistrictCollector for allotment of house site. Be it noted the petitioner is aresident of Gurther Village, Thorrur Mandal in Warangal District. Respondent No.2 also informed the same to the office of the ChiefMinister by letter in Lr.No.E5/6300/2004 dated 08.04.2005. Aggrievedby these two letters, the petitioner filed instant writ petition, inter alia, seeking a direction to the respondents to allot house site admeasuring300 sq. yards at Jawaharnagar, Hakimpet, Shameerpet Mandal, RangaReddy District or in survey No.152 situated at Pappalaguda VillageRajendranagar Mandal in Ranga Reddy District.

The learned counsel for the petitioner relies on G.O.Ms.No.185dated 11.03.1997, whereunder the Government ordered allotment ofhouse site admeasuring 300 sq. yards to freedom fighters anywhere inthe State. There cannot be any dispute with regard to the entireguidelines issued by the Government in said Government order. However, when respondent No.2 says that no land is available in RangaReddy District for allotment of house site to the petitioner, the mattermust rest there without any further enquiry. The petitioner, if so advised, may approach the District Collector, Warangal, and seek allotment ofhouse site. In this writ petition no direction can be issued to therespondents to allot house site at Jawaharnagar, Hakimpet, ShameerpetMandal in Ranga Redy District.

The writ petition, with the above observations, is accordinglydismissed. No costs.
