Upon receiving the reference, workmen had filed his claim statement stating that he was employed as Deputy Manager in Debt Management Department of Defence Colony Branch, New Delhi of IndusInd Bank Limited from dated 05.10.2015 to 10.09.2018. He performed his duties diligently and utmost sincerity and without any blemish during the said period and there was no complaint ever made against the workman regarding his services during the tenure he served with the bank. He further stated that pursuant to a customer’s complaint dated 23.07.2018, the Bank issued a charge sheet dated 07.08.2018 without affording the workman a proper opportunity of defence. The workman denied the allegations in his written statement dated 11.08.2018. The domestic enquiry was concluded on 14.08.2018, wherein the workman was allegedly pressured and threatened into admitting the charges. His services were dismissed by the bank on 10.09.2018. He has gone to the conciliation officer, but, it was resulted into failure. Hence, he filed the present claim with the prayer to set-aside the final order dated 10.09.2018 issued by the management and also direct the management to reinstate him along with back wages.

Management has filed its written statement. He had denied the averments made in his claim statement. He submitted that claim of the claimant is liable to be dismissed.

Rejoinder has been filed by the claimants denying the averments made in the written statements of the management and affirmed the facts mentioned in his claim statement.

After completion of the pleadings, vide order dated 04.05.2022, following issues have been framed i.e.-

In these circumstances, when the claimant is not interested in pursuing his case, this tribunal has no other option but to dismiss the claim. Hence, his claim stands dismissed. Award is passed accordingly. A copy of this award is sent to the appropriate government for notification as required under section 17 of the ID act 1947. File is consigned to record room.
