ORDER

Learned Counsel for the both parties are present. Mr Amogh Gupte, summoned witness is also present.

Mr. Ajay Kumar, learned counsel for the Petitioner cross-examines the summoned witness, Mr. Amogh Gupte.

During the cross-examination of the witness, a document, namely, Authorisation Letter dated 01.07.2026 was produced by the witness while answering question no. 4. Learned counsel for the Petitioner objected to the same on the ground that a document which was not produced while tendering the evidence affidavit before the court, cannot be produced to supplement the earlier document at this stage without permission of the Hon'ble Tribunal.

Learned Counsel for the Respondent asserted that when the Evidence by way of Affidavit was filed on behalf of the Respondent, the authority letter had already been exhibited along with the same. The Evidence somehow could not be adduced for the reasons beyond the control of the Respondents and today, witness is also carrying subsequent authority letter in order to supplement the earlier one and therefore, the Evidence should not be postponed merely on the reasons of such curable defect.

In view of the statements of learned counsel for both parties, the cross-examination of the witness is deferred at present and the matter is placed before the Hon'ble Bench for Orders/Directions.

Let this matter be listed before the Hon'ble Bench for Orders/Directions on any convenient date.
