BEFORE

HON'BLE MR. JUSTICE RAM KRISHNA GAUTAM, MEMBER

For Applicants/Appellants/

Petitioners Advocate

Mr. Upender Thakur, Ms. Vishakha U. Thakur, Ms. Karishma Singh, Ms. Shreya Kardam For Respondents Advocate None

ORDER

1. Case taken up.

2. Learned Counsel for petitioner mentioned that it is an ex-parte proceeding against Respondent No. 1. Evidence as well as written submission is said to have been filed on record. But, the date when the proceeding was directed to be ex-parte could not be specified, except the one, which was of the year 2021, and subsequently, by Court No. 1, this was not accepted to be of sufficient service. Rather, afresh direction was there for issuing a notice through Police Mode. Then what was the recourse after that, is not clear. At a belated stage, this file has been received as transfer from Court No. 1, with an order sheet of ex-parte proceeding.

3. Hence, Learned Counsel for petitioner is to go through the record and to apprise about the status of ex-parte proceeding, as well as placing arguments in this matter. A request is for a date.

4. List the matter on 05.01.2027 “for further hearing”.
