Jaswant vs. Lady Harding Medical College and ors. ID No. 176/2019

As a rule, an application for impleadment of legal heirs ought to be filed within 90 days. However, more than one year has elapsed, but no such application has been filed till date. Record further reveals that the cross-examination of the claimant had been deferred on 10.04.2023. In these circumstances, when no application for impleadment of legal heirs has been filed for a considerable period and no one has appeared on behalf of the claimant to participate in the proceedings, this Tribunal has no other option but to pass a ‘No Dispute Award’ in the matter. Award is passed accordingly. Let a copy of this Award be sent to the Appropriate Government for publication/notification under Section 17 of the Industrial Disputes Act, 1947. File be consigned to the Record Room.
