ORDER
1. Mr. Ramji Srinivasan, l earned senior counsel appearing for the appellant has insisted for interim relief especially about deferment of the ARR which is not permissible as submitted by the learned counsel for the appellant. In the eyes of law it is in violation of AERA Act as well as in violation of Concession Agreement, which is at Annexure A-3.
2. It is further submitted by Mr. Ramji Srinivasan, l earned senior counsel appearing for the appellant that the issue for the interim relief has already been decided by the Tribunal in various AERA Appeals. Several other issues have been highlighted by the learned senior counsel appearing for the appellant for grant of interim relief as prayed for in the memo of this AERA Appeal.
3. We have heard Mr. N. Venkataraman, learned A.S.G. appearing on behalf of AERA. It has been submitted by the learned A.S.G. that instead of granting any interim relief, let final hearing of the AERA Appeal be fixed as the pleadings of this AERA Appeal are almost completed except rejoinder affidavit.
4. In view of this submission, we hereby direct the Registry of this Tribunal to enlist the AA 2/2026 under the heading "For Hearing" on 03.11.2026.
5. Meanwhile, appellant is permitted to file rejoinder affidavit, copy whereof shall be supplied to the respondent.
