ORDER
After hearing Learned Counsel for both sides, the following issues are framed in agreement of the Counsel:-
1. Whether the Petitioner is entitled to recovery of Rs.21,55,418/- from the Respondent alongwith interest @18% on the aforesaid outstanding amount towards the services rendered by the Petitioner to the Respondent.
2. Whether, under the terms of the Purchase Orders, the Respondent was bound by a minimum service/lock-in period of one year from the date of commissioning of the respective links and that after expiry of the minimum service/lock-in period, whether the Respondent was contractually required to provide one month's prior notice for termination of the services, and whether the Respondent failed to comply with the said requirement?
3. Whether any amount relating to Bhishagni Network Private Limited has been included in the outstanding amount claimed under the present petition?
As prayed for, let the Evidence Affidavit be filed by the Petitioner within four weeks from today.
