Tapas Bouri Vs. Bansra Colliery, Kunustoria Area, M/s. ECL

PRESENT : For the Union / Workman : Mr. R. K. Tripathi, union representative For the Management : Management representative.

Order dated : 24.10.2025

Mr. R. K. Tripathi, union representative for Koyala Mazdoor Congress filed written statement on behalf of Tapas Bouri, dismissed workman. Agent, Bansra Group of Mines filed an application praying for adjournment to file Vokalatnama. No accommodation is sought for filing written statement. Let the case be fixed on 08/12/2025 for ex-parte hearing. On a perusal of the schedule and Terms of reference I find that question for determination is whether denying reinstatement of Tapas Bouri in service by the management of ECL is justified and legal. Primary question for adjudication herein is not related to his dismissal but for his reinstatement in service. It further appears from the concluding line of the Terms of reference that another question for determination has been formulated as to what relief the concerned dependent of the deceased is entitled. Schedule and Terms of reference are ambiguous and the Tribunal is at a miss as to whether Tapas Bouri is a dismissed employee or dependent of the deceased employee. Concerned union is directed to seek necessary corrigendum of the schedule and Terms of reference. To date.
