10.09.2020 Learned counsel for the Appellant submits that the observations made regarding the conduct of the Resolution Professional are unwarranted. However, the matter not having been referred to the IBBI for initiating any action for misconduct, the Appellant seeks to withdraw the appeal with liberty to raise the issue for expunction of remarks and observations before the Adjudicating Authority.

We allow the Appellant to withdraw the appeal with liberty to approach the Adjudicating Authority for expunction of the remarks in regard to his conduct during the ‘corporate insolvency resolution process’.

The appeal is accordingly disposed off as withdrawn.
