21.12.2020: In terms of the impugned order personal appearance of Appellant has been sought by the Adjudicating Authority (National Company Law Tribunal), Principal Bench, New Delhi, for 10th October, 2019 which has already elapsed. That apart, review is stated to be pending before the Adjudicating Authority and the Adjudicating Authority is stated to have observed verbally that the review is not maintainable.
Today Mr. Harish Katyal, learned counsel for the Appellant submits that the review has been dismissed but the order is yet to be made available. Since this appeal has already been rendered infructuous, the same is permitted to be withdrawn as prayed for by learned counsel for the Appellant. The Appellant shall at liberty to seek appropriate legal remedy. Contd/-……..
