as penalty. The writ petitioner preferred an appeal against the said order before the appellate authority on 02.01.2026 along with delay condonation application, which came to be rejected by virtue of order dated 04.02.2026
passed by the Additional Commissioner, Grade-II (Appeal), Zone-1, State Tax, U.P., Prayagraj.
5. Questioning both the orders, the present petition has been preferred.
6. Learned counsel for the petitioner, as per instructions received from his client, is confining his relief at this juncture to the order dated 04.02.2026
passed by the respondent no. 3 dismissing the appeal on the ground of delay.
It is contended that a specific ground disclosing the reasons for delay was taken but the same has not been considered and brushed aside.
7. Sri Shashikant Mishra, on the other hand, submits that though the appellate order is not happily worded, but admittedly there is a delay.
However, according to him, propriety demanded that the order impugned ought to have been passed after considering the contention raised therein.
8. I have heard the counsel for the parties and perused the record carefully.
9. Apparently, an ex-parte order came to be passed on 16.04.2024 by the respondent no. 2, against which an appeal was preferred, which came to be rejected on 04.02.2026 on the ground of delay. The appeal came to be preferred by the petitioner on 02.01.2026 and the same was delayed by as many as 510 days, i.e. 17 months.

11. A bare perusal of the order impugned would reveal that the same though is of two pages, but there is no consideration of the ground taken in the memo of appeal for condonation of delay, once a ground is taken, tenable or untenable in entirety, which has not been done. Since a statement has been made by the learned Standing Counsel that the matter may be remitted back, thus, without delving further into the issue, the petition is being decided in the following terms:-
(i) The order dated 04.02.2026 passed by Additional Commissioner, Grade- II (Appeal), Zone-1, State Tax, U.P., Prayagraj / third respondent is set aside.
(ii) The matter stands remitted back to the authority to consider the appeal including the delay condonation application and to pass orders in accordance with law within a period of two months.
12. Needless to point out that this Court has not gone into the merits of the matter and all questions are left open to be decided by the Appellate Authority.
13. With the aforesaid observations, the petition stands disposed of. October 9, 2026 N.S.Rathour
