(Through Virtual Mode) 17.11.2020: After hearing learned counsel for the Appellant we find that there is no decision on merit as the Adjudicating Authority (National Company Law Tribunal), New Delhi, Court IV has deferred consideration of the application keeping in view the fact that the issue of insolvency application against Personal Guarantor is pending consideration before the Hon’ble Apex Court. Resolution Professional has been directed to prepare and submit the report under Section 99 of the I&B Code of which the Appellant is aggrieved. If in this regard the Appellant has any reservation as regards procedure applied, it will be open to the Appellant to approach the Adjudicating Authority for seeking any clarification. The appeal is disposed of with aforesaid observation.
