1. Heard learned counsel for the parties.

2. Petitioner's arms license was cancelled and appeal thereof was also dismissed on a ground that he was involved in a case for offence of murder, wherein after investigation, charge-sheet is being filed, therefore, at this stage more than prima-facie case exists against the petitioner.

3. In the above background, an argument of learned counsel for the petitioner that on basis of statements of witnesses recorded during investigation that licensed firearm was not misused cannot be accepted since petitioner's firearm license was canceled on a ground that petitioner was involved in a case of murder, wherein after investigation his involvement in crime was found that along with co-accused assaulted one person by lathi, danda, who died and a charge-sheet has already been filed, therefore, in such circumstances where there is a more than a prima-facie case against him; to allow petitioner to keep licensed firearm would be detrimental for security of public peace and public safety, therefore, there is no illegality in the impugned order.

4. However, in case the petitioner is granted acquittal in the criminal case after Trial, he will be at liberty to approach the Licensing Authority by way of filing a fresh application for revocation of order of cancellation of arms license, and it will be decided in accordance with law.

5. Writ Petition is disposed of with aforesaid liberty.
