1. We have heard learned counsel for the petitioners and Shri Ambrish Shukla, learned Additional Chief Standing Counsel for the State- respondents.

2. The only prayer made in the writ petition is that the application filed by the petitioners raising objections to the amount of compensation awarded to them on account of acquisition of land has not been referred to the LARA Court by respondent No. 2.

4. Shri Ambrish Shukla, learned Additional Chief Standing Counsel for the State-respondents, resists the relief and submits that the applications filed by the petitioners are barred by limitation.

5. Be that as it may, once the petitioner has filed an application raising objections to the amount of compensation awarded to him, the same deserves to be referred to the court of competent jurisdiction to consider even the issue of limitation, namely, as to whether the application was filed within the time prescribed under Section 18 of the Land Acquisition Act, 1894, and whether the claim deserves to be adjudicated on merits.

6. The application shall be referred to the court of competent jurisdiction within three months from the date of receipt of a certified copy of this order.

7. The writ petition is, accordingly, disposed of.

8. It is made clear that the court concerned shall also consider the objection of limitation raised by learned counsel for the respondents.
