1. This is a plaintiff's petition. In the suit filed by plaintiff, an application for grant of temporary injunction was moved which was allowed by the trial Court, against which, defendant had preferred misc. civil appeal which has been allowed and the order of trial Court has been set aside and matter has been remanded back to the trial Court to decide 6-C application afresh.
2. After hearing counsel for the parties and perusing material on record, I find that this writ petition has been against the remand order. As the matter has already been remanded back by appellate Court to decide 6-C application afresh, no interference is caused in the order impugned.
3. However, trial Court is hereby directed to decide application 6-C afresh post remand within a period of one month from the date of production of certified copy of this order strictly in accordance with law, after hearing all the affected parties, without being influenced by findings recorded by the appellate Court.
4. For the period of one month, parties to maintain status quo over the property in dispute.
5. With the aforesaid observations, present writ petition stands disposed of.
