20.10.2020 This appeal has been filed against the interim order. The main matter was pending before the Adjudicating Authority (National Company Law Tribunal) Kolkata Bench, Kolkata when the impugned order came to be passed and ‘Resolution Professional’ was directed not to proceed further and take any decision which is detrimental to the ‘CIRP’ proceedings including the encashment of fixed deposit. The matter was adjourned to 9th October, 2020.
Since the date of hearing has elapsed and the matter is still pending before the Adjudicating Authority, this appeal does not survive for consideration and if the Appellant is aggrieved of the interim direction, he can agitate the issue before the Adjudicating Authority itself who will pass an appropriate order after hearing the parties.
The appeal stands disposed of.
