1. This is a defendants' petition. In the suit filed by the plaintiff- respondent, an application for grant of temporary injunction was moved in which ad-interim injunction has been granted and notices have been issued. Defendants-petitioners have appeared in the said suit and filed their objections under Order 39 Rule 4 CPC, which are pending consideration. The sole prayer made in the writ petition is for expeditious disposal of the temporary injunction application along with objections.
2. As no useful purpose would be served in keeping the matter pending or calling for counter affidavit, or issuing notice to the private respondent, at this stage, the writ petition is being disposed of directing the Civil Judge (Senior Division), Bareilly to decide temporary injunction application filed in Original Suit No.167 of 2025 along with objections filed by defendants- petitioners, in accordance with law, after hearing all affected parties, preferably within a period of one month from the date of production of certified copy of this order, considering.
3. With the aforesaid direction, present writ petition stands disposed of.
4. It is made clear that this Court has not adjudicated the case on merit. October 6, 2026 SK Goswami Versus Counsel for Petitioner(s) : Ashish Dwivedi, Gunjan Bhardwaj Counsel for Respondent(s) :
