1. This is a plaintiff's petition. Plaintiff filed a suit for declaring the will deed as null and void. In said suit, an application under Order 6 Rule 17 CPC was moved, which was allowed by the trial court. Against which, a civil revision has been preferred, which has been allowed by the order impugned and the matter has been remitted back to the trial court to decide the application afresh.
2. As the writ petition has been filed against a remand order and the application under Order 6 Rule 17 CPC is pending consideration, no useful purpose would be served in keeping the matter pending or calling for counter affidavit, the writ petition is disposed of without causing any interference to the order impugned with a direction to the trial court to expedite the application filed under Order 6 Rule 17 CPC and decide the same within a period of two months from the date of production of certified copy of this order, in accordance with law, without being influenced by the finding recorded by the revisional court.
3. With the aforesaid directions, the writ petition stands disposed of. October 6, 2026 A. V.
