1. Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material brought on record.

This application under Section 528 BNSS has been filed seeking direction to the Sub Divisional Officer, Basti for early decision of application dated 17.10.2025 filed by the applicant under Section 340 Cr.P.C. in Case No. 0579/ 2019 (Computerized Case No. T201917140305791), Ajay Prakash Tripathi and others Vs. Ram Bihari, under Section 59 of U.P. Tenancy Act, 1939, pending before it, within stipulated period.

Considering the fact that the said application has remained pending since 2025, without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the Sub Divisional Officer, Basti to decide the application dated 17.10.2025 filed by the applicant under Section 340 Cr.P.C. in Case No. 0579/ 2019 (Computerized Case No. T201917140305791), Ajay Prakash Tripathi and others Vs. Ram Bihari, under Section 59 of U.P. Tenancy Act, 1939, in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, if there is no other legal impediment.
