HIGH COURT OF JUDICATURE AT ALLAHABAD TRANSFER APPLICATION (CIVIL) No. - 947 of 2025 Court No. - 35 HON'BLE DR. YOGENDRA KUMAR SRIVASTAVA, J. Heard Sri Sanjeev Singh, learned Senior Counsel, assisted by Sri Satish Kumar Sahu, learned counsel for the applicant, and Sri Shri Narayan Mishra, learned counsel appearing for the opposite party. The present transfer application has been filed, seeking transfer of Case No.1745 of 2023 (Ankur Pandey vs. Smt. Neha Agnihotri) under Section 13 of the Hindu Marriage Act, 1955, from the Court of Principal Judge, Family Court, Hardoi to a Court of competent jurisdiction at Agra. Learned counsel appearing for the opposite party has drawn attention of the Court to a judgment of this Court in Smt. Shivani Shankar vs. Somesh Shankar, 2026 (176) ALR 187, wherein it has been held that in the State of Uttar Pradesh, where the High Court functions through the Seat at Allahabad and the Lucknow Bench, the Bench exercising appellate jurisdiction over the subordinate Court concerned constitutes the appropriate forum for instituting the transfer application. Learned Senior Counsel appearing for the applicant has not disputed the aforesaid legal position. Following the decision in Smt. Shivani Shankar (supra), present transfer application is held to be not maintainable before this Bench. Consequently, the transfer application is permitted to be withdrawn, with liberty to the applicant to approach the Lucknow Bench of this Court in accordance with law, if so advised.
