AWARD
1. This is an application U/s 2A of the Industrial Disputes Act (here in after is referred as an Act) filed by the claimant stating that he was working with the management since 30.06.2015 as a Postman and his last drawn salary was Rs. 16,950/- per month. During his service period, he has not given any chance to the management to make any complaint to him nor was he charged while he was in service. He was deprived from the facilities available under labour laws and equal work, equal pay etc.
His duty was in D Block, Mayapuri Jung Market, New Delhi-64, Post Office and the post office comes under the M-2. Management himself kept him and from that time management gave his name to the Contractor i.e. M/s G A Digital Web World Pvt. Ltd., Regd. Office: No. 1 Hargobind Enclave, Vikas Marg Extension, Delhi-110092. Thereafter, management himself started paying salary to him since 01.01.2017 and started showing his name on their records. His services was illegally terminated by the management on 12.10.2018. He had sent the written demand letter 0n 13.10.2018 through registered post/speed post. The above said demand letter had been received by the management but management did not give any reply for the above said demand letter. He had gone to the conciliation, but it was resulted into failure. Hence, he filed the present claim with the prayer that he be reinstated with full back wages.
2. Management has filed its WS, denying the averment made in the claim statement of the claimant. He also submitted that claim of the claimant is not maintainable and liable to be dismissed.
3. After completion of the pleadings vide order dated 20.02.2020, following issues have been framed i.e.:
(i) Whether the proceeding is maintainable.
(ii) Whether the service of the workman was illegally terminated.
(iii) Whether there exists any employer & employee relationship between the management and the workman.
(iv) Whether the workman is entitled to relief of reinstatement and other consequential benefits.
4. Now, the matter is listed for arguments on the claimant’s application filed under section 11(3)(b) of the I.D. Act. However, neither the workman nor his AR has been appearing since long, despite providing a number of opportunities.
5. In these circumstances, when the claimant is not interested in perusing his case, this tribunal has no option but to dismiss his claim. Hence, his claim stands dismissed. Award is passed accordingly. A copy of this award is sent to appropriate government for notification under section 17 of the I.D. Act. File is consigned to record room.
