Heard learned counsel for the Appellant. He submits that while passing the impugned order, the case was not listed for considering any interim relief and the case was only fixed for consideration of an I.A. No. IA/62/KOB/2019 in TCP 22/KOB/19. It is also submitted that in the main Petition, no such interim relief is claimed which has been considered and granted by Ld. National Company Law Tribunal.
Therefore, the order be set aside.
Learned Counsel apprises that till date no Annual General Meeting has been held.
In such circumstances, we find that it better for the Appellant to approach the Ld. NCLT for reconsideration/modification of the order.
