**BEFORE CENTRAL GOVERNMENT INDUSTRIAL TRIBUNAL CUM LABOUR COURT, No. 1 DELHI**

**D-1/03/2024**

**M/s Green Land Telecom Services Private Ltd. vs. RPFC/APFC Delhi North & another.**

Present: Sh. Ghanshyam Mishra, Sh. Ajit Upadhyay & Sh. Tathagat, Ld. Counsel, for the Appellant. Sh. S.N. Mahanta, Ld. Counsel & Sh. Anil Kumar Antil, A/R for the Respondent.

**Order dated-28.04.2025**

Counsel has filed the additional affidavit along with documents. He submits that he has been filing this additional affidavit in pursuance of the order passed by this tribunal on 08.04.2024.

Appellant counsel has drawn the attention towards the order dated 08.04.2024 whereby the appellant counsel was permitted to bring an additional affidavit in support of the application filed u/s **70 of the EPF & MP Act, 1952** within seven days, providing copy thereof to Ld. counsel for the respondent. When asked as to why he has not filed the additional affidavit within the time frame. He has stated that the counsel Sh. Ghanshyam Mishra, was appointed recently. However, the memo of appearance filed on 06.05.2024 by Sh. Kamal Kant Tyagi- proxy counsel, is found on record where Sh. Ghanshyam Mishra was appointed counsel in the year 2024 itself. Even the Vakalatnama produced by the applicant has been signed on 10.07.2024, therefore, it cannot be said that he has been appointed recently.

Appellant counsel is not fair enough in his submissions. However, keeping in view of the spirit of the order dated 08.04.2024 whereby appellant counsel was permitted to file additional affidavit, the additional affidavit along with documents is taken on record subject to the cost of Rs.10,000/- which is to be deposited by him within three weeks in the PM Relief Fund. Put up on 26.05.2025. Copy of this order be sent to the counsels of both the parties through email.
