**Order Dated-29.04.2025**
Office has reported that communication has been sent through email to the appellant counsel Sh. Rajiv Shukla for hearing. Record perused. Application for condonation of delay was allowed vide order dated 12.07.2023. Even earlier on 24.03.2025 this tribunal had restrained the department from taking any coercive action. Since then appellant has not been representing effectively. Even on 08.04.2024 adjournment was given at the request of appellant counsel. Since, no hearing took place in between, for abundant caution notice was issued to the appellant counsel to appear and argue on the application u/s 70 of the EPF & MP Act, 1952. However, despite being served, nobody has appeared. Hence, appeal be dismissed for want of prosecution. In the meanwhile, interim orders also stands vacated. Department is at liberty to proceed further to recover the amount. Copy of this order be sent to both the parties through email.
