ORDER

19.08.2026

Heard Ms. R Atsula Kips, learned Counsel for the applicant and Mr.P.J.Barman, learned CGSC appearing for the respondents.

From the perusal of the record, it transpires that though the Counter Affidavit has been filed by Respondents No.1 to 4, no PPO has been filed to establish that benefit has been granted to the applicant by way of payment of pensionary benefits from 15.03.2009 to 31.03.2015. To establish this fact, the respondents are directed to file the correct PPO before this Tribunal on the next date of listing. If PPO has been issued for the said period and Respondent No.6, i.e., The Chief Manager, State Bank of India, CPCC, Centralised Pension Processing Centre, Guwahati, has not disbursed the amount, only then it can

be established to be default of Respondent No.6.

Further, as we have observed that Respondent No.5, The Deputy Director, Zila Sainik Welfare Officer, Nagaland, is not a necessary party, hence there is no need to serve notice upon him.

However, it will be appropriate to issue summons to Respondent No.6, The Chief Manager, State Bank of India, CPCC, Centralised Pension Processing Centre, 3rd Floor, NH-37, Lokhra Chariali, Guwahati-781034, for filing Counter Affidavit, if any. In this regard, the applicant's counsel is to take step both through Registered Post as well as through electronic mode. After taking steps, summons will be sent to Respondent No.6. This process be completed by **30.09.2026**.

List the matter as and when this Bench reassembles next.

Copy of the order be provided to the learned Counsel for the respondents *dasti*.
