1. Heard learned counsel for petitioners and learned State counsel for opposite parties.
2. The present petition has been filed seeking the following main reliefs:- "(i). Issue a writ, order or direction in the nature of Mandamus thereby commanding and directing the opposite parties to pay the pension to the petitioners and other post retiral benefits to the petitioners in old pension scheme, in the interest of justice.
(ii) Issue a writ, order or direction in the nature of Mandamus thereby commanding and directing the opposite parties to consider and decide the representation of petitioner, which is contained as Annexure No.
to this writ petition, in the interest of justice.."
3. Since consideration of petitioners' grievance would entail factual aspects, without entering into merits of the case, liberty is granted to petitioners to file fresh individual Versus Counsel for Petitioner(s) : Shiv Pravesh Dhar Dubey Counsel for Respondent(s) : C.S.C. Lal Singh And 14 Others .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Deptt. Of Irrigation Lko And 6 Others .....Respondent(s)
representations before concerned authority. In case such representations are filed, the same shall be decided in the light of judgment rendered by this Court in the case of Shiv Autar Sharma & Ors. versus State of U.P. & Ors., Writ A No.810 of 2024 in case the same is applicable within a period of eight weeks from the date a certified copy of this order is produced before the said authority.
