1. The present petition has been filed by the petitioner seeking appointment on compassionate ground on any suitable post under the relevant Dying in Harness Rules of the Food Corporation of India and by virtue of an amendment in the petition has also sought for quashing of the impugned order dated 03.01.2006 and 21/24.03.2006 passed by the respondent no. 1 (Food Corporation of India).

2. This petition was filed way back in the year 2005 and it is available from the order sheets that no interim order has been passed by this Court. No one was present for the petitioner on 05.05.2025 and 31.10.2025. Today, when the matter was called in the revised list, there is no one present for the petitioner nor for the contesting respondent-Food Corporation of India and only counsel for the State-Sri Badrish Kumar Tripathi, Additional Chief Standing Counsel was present and submitted that it is quite possible that since the petitioner has lost interest in the present petition, he is not prosecuting the same.

3. Having heard learned Counsel for the State, apparently it seems that the petitioner has lost interest in the present petition because of the nature of relief having been sought in the present petition as the same has become irrelevant/meaningless due to efflux of time. In any case, the petitioner has not appeared since the year-2009. Keeping in view of the above, this petition seems to be infructuous, and therefore, the same is being dismissed for want of prosecution. Versus Counsel for Petitioner(s) : Pankaj Verma Counsel for Respondent(s) : C S C, A.K. Singh, S.K. Singh Munna Lal .....Petitioner(s) Food Corpopration Of India Thru Chairman And M D And 2 Ors .....Respondent(s)

4. Interim order, if any, stands vacated.

5. Needless to say, the petitioner is granted liberty to revive the present petition in accordance with law, if the cause survives. . (Abdhesh Kumar Chaudhary,J.)
