3. Learned Senior Advocate appearing on behalf of the petitioner submits that by an order dated April 22, 2025, a Co-ordinate Bench of Versus Counsel for Petitioner(s) : Ravi Shanker Singh, Aniket Kumar, Kirti Veer Singh Counsel for Respondent(s) : C.S.C. Jeevendra Kumar Pal .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Social Wrlfare Deptt. Lko And 5 Others .....Respondent(s)

this Court had directed the District Level Caste Scrutiny Committee to ascertain the caste status of the petitioner keeping in mind the decision of the Hon'ble Supreme Court in Kumari Madhuri Patil & Another Vs. Additional Commissioner, Tribal Development & Others; reported in 1994 (6) SCC 241; and following the said judgment of the Supreme Court, a vigilance officer was required to be appointed to carry out the enquiry with regard to the petitioner.

4. It appears that the District Level Caste Committee has by an order dated November 7, 2025 passed an order without having setup the vigilance officer and without carrying out the enquiry as per the judgment in the case of Kumari Madhuri Patil (supra).

5. In light of the above, the impugned order dated November 7, 2025 is quashed and set aside with a direction upon the concerned authorities to immediately appoint a vigilance officer and carry out the enquiry in terms of judgment of the Supreme Court in the case of Kumari Madhuri Patil (supra). The entire exercise should be completed within a period of eight weeks from date.

6. The writ petition is disposed of in the aforesaid terms. December 19, 2025 cks/- WRIC No. 11835 of 2025 2 (Manjive Shukla,J.) (Shekhar B. Saraf,J.) Digitally signed by :- CHANDRA KANT SINGH High Court of Judicature at Allahabad, Lucknow Bench
