A preliminary objection has been raised by learned D.S.G.I., Sri S. B. jurisdiction for challenging the order passed by the learned Central Administrative Tribunal at Allahabad cannot be exercised by this Court at Lucknow, even though part of the cause of action is at Lucknow. Learned counsel for the petitioner has relied upon Rule 6 of the Central Administrative Tribunal (Procedure) Rules, 1987. We have gone through the Rules and find that the said rule governs only the original application to be filed before the Central Administrative Tribunal and not the writ jurisdiction to be exercised by this Court. The writ jurisdiction to be exercised by this Court is governed by the Allahabad High Court Rules and the Constitution of India. This petition is dismissed as withdrawn, with liberty to the petitioner to file a fresh petition at Allahabad. The certified copies of all the documents filed with this writ petition shall be returned to the counsel for the petitioner forthwith.
