1. Heard the learned counsel for the petitioner and the learned Standing Counsel who appears on behalf of the State-respondent nos.3 and 4 and Shri Varun Pandey who appears on behalf of the Opposite party nos.1 and 2.
2. This petition has been filed by the petitioner with the following main prayers:- "i) Issue a writ, order or direction in the nature of Mandamus commanding the opposite parties, especially Opposite party no.2 to renew the Passport No.N2118277 of the petitioner, in the interest of justice.
ii) Issue a writ, order or direction in the nature of Mandamus commanding the opposite party no.2 to consider and decide the Representation dated 16.11.2025 as early as possible, in the interest of justice."
3. It is the case of the petitioner that he is working in Saudi Arabia and his Passport expired on 04.08.2025. He has made an application for issuance of a new passport which has not been considered by the Respondent. Thereafter, a fresh Passport was issued to the petitioner but on Police Clearance Report being adverse regarding FIR lodged Versus Counsel for Petitioner(s) : Ramesh Kumar Srivastava Counsel for Respondent(s) : A.S.G.I., C.S.C. Rajesh Kumar .....Petitioner(s) U.O.I. Thru. Secy. External Affairs New Delhi And 3 Others .....Respondent(s)
in Case Crime No.433 of 2020, under Sections 323, 504, 506 IPC, at Police Station Mohanganj Amethi, a Show Cause Notice was issued to the petitioner.
4. The counsel appearing on behalf of the Regional Passport Officer, Lucknow, has stated that Show Cause Notice has been issued to the petitioner by the Consulate at Jeddah. The Regional Passport Officer at Lucknow has no role to play in the matter. The petitioner may submit his explanation to the Consulate at Jeddah and appropriate orders may be passed thereafter by the Consulate at Jeddah.
