By means of the present application, the applicant has impeached the order dated 23.09.2025, which reads as under:- "विषयः मु0अ0सं0-12/2023 धारा-419,420,467,468,471, 370, 120बी भादवि व धारा -14 विदेशी अधिनियम 1948 व धारा-2(1), 12(ए), 12(2) पासपोर्ट एक्टट 1967 थाना- एटीएस, लखनऊ के वांछित अभियुक अब्दुल गफ्फाफार पुत्र मरघूब अहसन निवासी-जे. 10, बाटला हाऊस, नियर खलीउल्लाला मस्जिद ओखला नई दिल्लीली के विरुद्ध प्रोोसेस अन्ततर्गत धारा -82/83 द.प्र.स. जारी करने के सम्बबन्धध में।
महोदय,
सादर अवगत कराना है कि मु0अ0सं0-12/2023 धारा-419, 420, 467, 468, 471, 370, 120बी भादवि व धारा 14 विदेशी अधिनियम 1946 व धारा 12 (1), 12(10), 12(2) पासपोर्ट एक्टट 1967 थाना एटीएस, लखनऊ की विवेचना मेरे द्वाारा सम्पापादित की जा रही है। जिसमें अभियुक अब्दुल गफ्फाफार पुत्र मरधून अहसन निवासी जे-10, बाटला हाऊस, नियर खलीजल्लाला मस्जिद ओखला नई दिल्लीली मुकदमा उपरोक्त का वांछित अभियुक्त है, जिसकी गिरफ्तातारी हेतु मा० न्यायायालय द्वाारा गिरफ्तातारी अधिपत्र दिनांक 13-03-2024 को जारी किया गया, जिसकी गिरफ्तातारी हेतु दिनांक 31-01-2025, 01-02-2025 एवं 08-07-2025 को उसके निज स्थाथान- जे-10, बाटल हाउस नियर खलिउल्लालाह मस्जिद जामिया नगर ओखला नई दिल्लीली अभियुक्त द्वाारा संचालित उसकी क्लिनिक एवं संम्भाभावित स्थाथानों में दबिस दी गयी, अभियुक्त दस्ततयाब नहीं हुआ न ही उसके सम्बबन्धध में कोई जानकारी मिली है।
उक्त के सम्बबन्धध में मुझ विवेचक द्वाारा दिनांक 13-08-2025 को चाछित अभियुक्त अब्दुल गफ्फाफार पुत्र मरघूब उपरोक्त के विरूद्ध प्रोोसेस अनुमति धारा-82/83 द.प्र.स. जारी करने हेतु अनुरोध किया गया, जिसके क्रम ने मा० न्यायायालय द्वाारा दिनांक 13-03-2025 को पुनः एन.बी .डब्लूलू जारी किया गया, जिसके अनुपालन में अभियुक्त की गिरफ्तातारी हेतु दिनांक 22-00-202 को पुन निरीक्षक/विवचेवक मय हमराही पुलिस बल के साथ लेकर जिला साऊथ ईस्टट दिल्लीली Versus Counsel for Applicant(s) : Azizullah Khan, Abhishek Upadhyay, Mohammad Alishah Faruqi, Tajdar Ahmad Counsel for Opposite Party(s) : G.A. Dr. Abdul Ghaffar .....Applicant(s) State Of U.P. Thru. Addl. Chief/ Prin. Secy. Home Lko. And 2 Others .....Opposite Party(s)
के थाना जामिया नगर के प्रभारी निरीक्षक को मुकदमा उपरोक्त के वांछित अभियुक्त अब्दुल गफ्फाफार के निवास स्थाथान में थाना जामिया नगर, उसकी अमन क्लिनिक एवं फार्म हाउस निवास स्थाथान धौज मार्केट तहसील बलभगढ़ जिला फरीदाबाद हरियाणा मय पुलिस बल के दिनांक 22-08-2025, 23-08-2025 एवं 24-08-2025 को दबिश दी गयी, जो घर क्लिनिक व फार्म हाउस पर मौजूद नहीं मिला, तत्पपश्चाात् आसपास तलाश की गयी, अभियुक दस्ततयाब नहीं हुआ न ही उसके सम्बबन्धध में कोई जानकारी मिली है। अभियुक्त अब्दुल गफ्फाफार लगातार फरार चल रहा है एवं अपनी सम्पपति चोरी छुपे खुर्दबुर्द कर रहा है।
अतः महोदय से अनुरोध है कि अभियोग में वांछित चल रहे वांछित अभियुक्त अब्दुल गफ्फाफार पुत्र मरघूब अहसन निवासी-जे-10, बाटला हाऊस, नियर खलीउल्लाला मस्जिद ओखला नई दिल्लीली के विरुद्ध प्रोोसेस अन्ततर्गत धारा-82/83 द०प्र०सं० जारी करने की कृपा करें है, ताकि मुकदमी उपरोक्त में अग्रेेतर कार्यवाही की जा सके।"

The order dated 23.09.2025 has been impeached on the basis of pronouncement of Apex Court in the case of Inder Mohan Goswami and another vs. State of Uttranchal and others, (2007) 12 SCC 1; Sunil Tyagi vs. Govt. of NCT of Delhi and another, 2021 SCC OnLine Del 3597; Satender Kumar Antil versus Central Bureau of Investigation and another, (2022) 10 S.C.R. 351 : (2022) 10 SCC 51 and Musheer Alam vs. State of Uttar Pradesh and Another, 2025 SCC OnLine SC 116 .
4. Learned AGA-I supported the order passed by the Magistrate. He says that reasons have been indicated in the application preferred by the I.O., Anand Kumar Tiwari and therefore recording of reasons of the concerned Magistrate is not required.
5. This Court finds that the submissions of the learned counsel for the State are fallacious in view of the law laid down by the Hon'ble Apex Court in the judgement referred above.
6. In view of the aforesaid, the order dated 23.09.2025 is set aside.
