1. Heard Shri Ram Prasad Dwivedi, the learned counsel for the petitioner.

2. By means of the instant petition, the petitioner has sought issuance of a direction to the learned Civil Judge (S.D.), Shrawastin to decide the suit no.1005 of 2024 titled Ram Pheran v. Chetai and Ors., expeditiously.

3. The learned counsel for the petitioner has submitted that the suit was filed in the year 2014, for cancellation of the sale deed by original plaintiff Ram Naresh, who was 70 years of age at that time. During pendency of the suit, Ram Naresh expired and the petitioner has been sustituted in his place.

4. The order sheet of the trial Court reveals that the suit is at the stage of cross- examination of PW-1.

5. As all the courts are working under immense workload, when the suit filed in the year 2019 has already reached the stage of cross-examination of plaintiff's witnesses, there is no occasion to issue any direction for expeditious disposal of the suit at this stage, more particularly, when the learned counsel for the petitioner has admitted that the plaintiff has not filed any temporary injunction application in the suit.

6. The instant petition is disposed off leaving it open for the petitioner to file an appropriate application for expeditious disposal of the suit before the trial Court itself. December 11, 2025 -Amit K- Versus Counsel for Petitioner(s) : Ram Prasad Dwivedi Counsel for Respondent(s) :
